This legal notice governs the use of the website apartamentosdada.com. The conditions that apply to bookings are in a separate document: booking conditions. How personal data is handled is explained in the privacy policy.

The purpose of this website is the promotion and booking of three holiday apartments in Zarautz. Stays are managed, on the owner’s behalf, by the agency EGONA ZARAUTZ, S.L. (tax ID B-75137778).

II. Terms of use of the website

Purpose

The purpose of these terms is to govern access to and use of this website: the appearance of its screens, the navigation tree, and all the elements, contents and online services offered to users.

Apartamentos Dada reserves the right to modify at any time, without prior notice, the presentation and configuration of the website and of the contents and services incorporated into it, as well as to interrupt, disable or cancel any of them or access to them.

Access to the website is free and, as a general rule, free of charge, except for the cost of the connection through the telecommunications network contracted by the user.

The user

Accessing, browsing and using this website confers the status of user, and therefore all the terms set out here, and any subsequent amendments, are accepted from the moment browsing begins. We recommend reading them each time you visit the site.

The user is responsible for making proper use of the website. This responsibility extends to:

  • Using the information, contents, services and data offered without contravening these terms, the law, public morals or public order, and without harming the rights of third parties or the operation of the website itself.
  • The truthfulness and lawfulness of the information provided in the website’s forms. The user shall immediately report any circumstance that allows misuse of that information, so that it can be cancelled.

Merely accessing this website does not establish any kind of commercial relationship between Apartamentos Dada and the user.

The user declares that they are of legal age and have sufficient legal capacity to be bound by these terms. This website is not aimed at minors.

This website is published in Spanish, English, French and Basque, and is aimed at users of any origin interested in staying in Zarautz. The business and the relationship with the customer are governed by Spanish law, without prejudice to the rights granted to the user by the consumer protection legislation of their country of residence. Apartamentos Dada does not warrant that the website complies, in whole or in part, with the legislation of other countries; anyone accessing it from outside Spain must satisfy themselves that such access complies with the local rules applicable to them.

III. Access and browsing: exclusion of warranties and liability

Apartamentos Dada does not guarantee the continuity, availability or usefulness of the website, its contents or its services. Every effort will be made to keep the website running properly, but no warranty is given that access will be uninterrupted or error-free.

Nor is any warranty given that the content or software accessible through this website is error-free or will not cause damage to the user’s computer system. Under no circumstances shall Apartamentos Dada be liable for losses or damage of any kind arising from access to, browsing of or use of the website, including damage to computer systems or damage caused by the introduction of viruses.

Apartamentos Dada is not liable for damage caused to users by improper use of this website, nor for any outages, interruptions or telecommunications failures that may occur.

This website may make available to users links to websites belonging to or managed by third parties. Their purpose is to make it easier to find and access information available on the internet, and they may not be regarded as a suggestion, recommendation or invitation to visit them.

Apartamentos Dada neither offers nor markets, itself or through third parties, the products or services available on those linked sites, and does not warrant their technical availability, accuracy, truthfulness, validity or lawfulness. It never reviews or monitors their content, nor does it approve or adopt it, and it accepts no liability for damage that may arise from access to, use of, or the quality or lawfulness of those sites.

Anyone establishing a hyperlink from another website to this one should be aware that:

  • Reproduction, in whole or in part, of any of the contents or services of this website is not permitted without the express authorisation of Apartamentos Dada.

All rights reserved. The reproduction, distribution and public communication, including making available, of all or part of the contents of this website for commercial purposes, in any medium and by any technical means, is expressly prohibited without the authorisation of Apartamentos Dada.

Users may view the elements of the website and even print, copy and store them, provided this is exclusively for their personal use. Users may not remove, alter or tamper with any protection device or security system installed on the website.

If a user or a third party considers that any of the contents of the website infringes intellectual property rights, they must report it immediately to the contact address given in section I.

Apartamentos Dada reserves the right to bring such civil or criminal actions as it deems necessary in respect of improper use of the website and its contents, or breach of these terms.

The relationship between the user and Apartamentos Dada is governed by the legislation in force in Spain. Should any dispute arise regarding the interpretation or application of these terms, the parties submit to the courts that have jurisdiction under the law, without prejudice to the rights granted to the user by consumer protection legislation.
